Red marketing, LLC ("Red Marketing" or "we" or "us" or "our") respects the privacy of its users (also "you" or "your") that use our website located at www.getredmarketing.com, including other media channels, and our digital marketing services in general (collectively, our "Services"). The following Red Marketing privacy policy (this "Policy") is designed to inform you, as a user of our Services, about the types of information that we may gather about or collect from you in connection with your use of our Services. This Policy also is intended to explain the conditions under which we use and disclose that information and how we secure it. Each time you use our Services, however, the current version of this Policy will apply.

2. THE INFORMATION RED MARKETING COLLECTS AND WHY

When you access our website and use our Services, we collect some categories of information from you which are described below:

  • Personal Information that you Share during Phone Call:

    When you engage in a phone interaction with a Red Marketing’s agent for booking a service, we collect some personal information from you. This information is personal and can be used to directly identify who you are. The personal information we collect through phone calls include Realtor Name, Name of Realty, Email Address, Phone Number, Home Address, MLS Area, Broker Name, etc. We collect this information in order to identify you, contact you, and provide you our Services as requested.

  • Personal Information we collect when you contact us:

    When you access our website and reach out to us through our email address, we collect your email address. This will enable us to contact you or communicate with you when we need to reply to your request or pass a message across (when necessary).

  • Information we collect through Cookies and Facebook Pixel:

    When you visit our website, we collect cookies automatically through our programmed software. Cookies are bits of information that are programmed to track some activities about you for our marketing purposes. Cookies also help us to improve the functionality of the website and identify what features we need to improve on. In like manner, we use Facebook Pixel. Facebook Pixel is a code that is placed on our website to collect some information about users thereby helping us to track conversion from Facebook ads, optimize ads, build targeted audiences for future ads, and remarket to users who have already taken some action on our website.

3. HOW RED MARKETING DISCLOSES INFORMATION COLLECTED

Red Marketing will not share or disclose any of your information unless it is necessary or otherwise to fulfill our obligations. Red Marketing will only share or disclose personal information under the following circumstances:

  • By Law or to Protect Rights:

    When we believe the disclosure is appropriate, we may disclose personal information: (i) in connection with efforts to investigate, prevent or take other action regarding illegal activities, suspected fraud or other wrongdoings; (ii) to protect and defend our rights, property, or safety and other users of our Services as well; (ii) to comply with the applicable law or cooperate with law enforcement; (iv) to enforce our Terms of Service, other agreement or policies, in response to subpoena or similar investigative demand, a court order or a request for cooperation from a law enforcement or other government agency; (v) to establish or exercise our legal rights; and (vi) to defend against legal claims or as otherwise required by law.

  • Third-Party Service Providers:

    Red Marketing may share your personal information, which may include your name and contact information (including email address) with our authorized service providers that perform certain services on our behalf. For example, we use BrewMyIdea as a service provider for our digital marketing needs. In order for BrewMyIdea to carry out digital marketing services on our behalf, they may need access to some of your personal information. However, Red Marketing does not share your information with any service provider unless they need it to perform the task we have hired them to do and they are under contract to keep the information shared with them confidential.

  • Business Transfers:

    We reserve the right to transfer all personal information in our possession to a successor organization in the event of a merger, acquisition, bankruptcy or other sales of all or a portion of Red Marketing’s assets. Other than to the extent ordered by a bankruptcy or court order, the use and disclosure of all transferred personal information will be subject to this Policy. Personal information submitted or collected after a transfer, however, may be subject to a new policy adopted by the successor organization.

4. HOW RED MARKETING SECURES INFORMATION

Red Marketing is aware of the value of your personal information and that is why we take great steps and use the best technologies and physical measures to ensure its safety against theft, loss, misuse, or alteration. Not only do we limit the number of access to your shared information, but we also ensure it is properly stored on our CRM platform.

However, note that no matter how strong the measures we use or take towards securing your information, it may not be enough to fully counter every threat to your personal information. We cannot guarantee you that only people authorized to view your personal information will be able to. Red Marketing will not be responsible for any bypassing of information by third parties.

5. CHANGES TO THIS POLICY

Red Marketing reserves the right and discretion to change, update, or modify (collectively, "Changes") a portion or section of this Policy subsequently (with or without notices). Any Changes made to this Policy will be communicated at the top of this Policy by changing the Effective Date. Unless we say otherwise, our current Policy is applicable to all the information we already have about you. You should endeavor to check this Policy for Changes made to it.

6. GOVERNING LAW

This Policy shall be governed and construed by the laws of the State of California and the federal laws of the US without regards to conflict of laws and its provisions. Any dispute or claim arising out of your use of our Services or this Policy shall be resolved by Binding Arbitration as described in our Terms of Service.

7. HOW LONG RED MARKETING RETAINS INFORMATION

Red Marketing will not retain any information for longer than we need it. Any personal information you share with us through phone calls or through email will be retained for as long as you use our Services. In the event that you stopped using our Services, Red Marketing will delete all your personal information from our database.

8. CHILDREN (MINOR) POLICY

The Red Marketing Services and our website is not intended for children (users below 13 years of age) except stated otherwise by us or by the law. By submitting personal information to us, you represent to us that you have attained the age of majority or older. If we become aware that you are a minor using our Services, we may be forced to take actions, including without limitation, terminating your use of our Services.
